Many variables come into play when assessing an aquatic weed/algae problem and choosing the best management method. When choosing aquatic herbicides/algaecides, the first step is always proper pest identification. However, many people do not realize that legal use of EPA approved aquatic products is dictated by the product label. Look at any registered aquatic herbicide or algaecide and you will find the following statement:
“It is a violation of Federal law to use this product in a manner inconsistent with its labeling”
What does this mean for pond management professionals? It means that every precaution should be taken to ensure that the label is understood and adhered to. Failure to do so can result in federal fines and possible loss of our state issued TDA applicator’s license. As an HOA, you may be subject to violation of your TCEQ TXG870000 permit that authorizes the proper application of chemical pesticides to your pond.
The product label legally defines everything including (but not limited to) personal protective equipment, storage, mixing, site use, dose rates, and eventual disposal of the containers.
Below are just a few statements taken from some common aquatic herbicide labels:
“Apply in early spring when weeds are actively growing with a minimum of 24 hours contact time”
“Do not treat more than ½ of the waterbody to avoid depletion of oxygen due to decaying vegetation”
“Wait at least 10-14 days between treatments”
“Apply only when wind speed is less than or equal to 10 mph”
“Do not re-treat the same section of water within 28 days of application”
Most of these statements are weather related. For example, “24 hours contact time” means that rain must not be in the immediate forecast. Hot weather increases the risk of post-treatment “depletion of oxygen”. And “wind speed” is self-explanatory.
This means that we may not be able to apply products on a given day (or time) during our regularly scheduled management visits. Therefore, patience is often a virtue with pond management programs. There will be times when customers must tolerate unsightly pond conditions until constraints allow for legal and effective treatment. Should the weather interfere with our normal routine, you will be notified in our inspection reports so you can rest assured that we are aware of the issues and will address them in line with the product labels to keep everyone compliant with Federal and State laws.
